These Terms and Conditions ("Terms") govern your access to and use of richardovervold.com (the "Site"), operated by Richard Overvold, a licensed Florida Real Estate Sales Associate (SL3610484) with Mutter Realty ("I," "me," or "my"). These Terms apply to all visitors, users, and others who access the Site.
These Terms are governed by the laws of the State of Florida, including but not limited to Chapter 475, Florida Statutes (Real Estate Brokers, Sales Associates, and Schools), Chapter 455, Florida Statutes (Business and Professional Regulation), and the Florida Administrative Code Chapter 61J2.
2. Nature of This Website
This Site is a personal professional website intended to provide general information about my real estate services and to facilitate initial contact with prospective clients. It is not:
- An offer or contract to represent you in any real estate transaction
- Legal, tax, financial, or investment advice
- A guarantee of any property value, market outcome, or return on investment
- A Multiple Listing Service (MLS) or IDX property search portal
3. License and Brokerage Relationship
Richard Overvold holds a Florida Real Estate Sales Associate license (SL3610484) issued by the Florida Department of Business and Professional Regulation (DBPR) through the Florida Real Estate Commission (FREC). As required by Florida law, all real estate brokerage services are performed under the supervision of the broker of record at Mutter Realty.
I am not an independent broker. Any real estate transaction you enter into in connection with my services will be conducted through Mutter Realty as the licensed brokerage.
Florida Administrative Code Rule 61J2-10.025 requires real estate advertising to make clear that the public is dealing with a real estate licensee, to include the licensed brokerage name, and to avoid fraudulent, false, deceptive, or misleading statements. On this Site, Mutter Realty is the licensed brokerage name and Richard Overvold is identified as a Florida Real Estate Sales Associate.
4. No Agency Relationship Created
Accessing this Site, submitting the contact form, or communicating with me through any channel does not, by itself, create a listing agreement, buyer brokerage agreement, single-agent fiduciary relationship, or confidential relationship.
Florida law presumes that real estate licensees operate as transaction brokers unless a single-agent relationship or no-brokerage relationship is established in writing. Required brokerage relationship disclosures will be provided at the appropriate time under Section 475.278, Florida Statutes. You should not send confidential information until representation and confidentiality have been confirmed in writing.
5. No-Solicitation Disclosure
Nothing on this Site or in any communication initiated through this Site constitutes a solicitation if:
- You are currently represented by a licensed real estate broker or sales associate; or
- Your property is currently subject to an active listing agreement with a licensed real estate brokerage.
This disclosure is made in compliance with Florida real estate license law and FREC rules.
6. Fair Housing Compliance
Equal Housing Opportunity. Real estate services are offered without discrimination and in compliance with applicable federal, state, and local fair housing laws.
I am committed to full compliance with all applicable fair housing laws, including:
- The Federal Fair Housing Act (42 U.S.C. § 3601 et seq.), which prohibits discrimination based on race, color, national origin, religion, sex, familial status, or disability;
- The Florida Fair Housing Act (Sections 760.20-760.37, Florida Statutes), including Florida Statute 760.23, which prohibits discriminatory housing notices, statements, and advertisements;
- Any applicable local fair housing ordinances in Brevard County and its municipalities.
I do not discriminate against any person in the terms, conditions, privileges, advertising, showing, negotiation, sale, rental, financing, or brokerage services of any real estate transaction on the basis of any protected class under applicable law.
7. Accuracy of Information
While I make reasonable efforts to keep the information on this Site accurate and current, I make no representations or warranties of any kind, express or implied, as to the completeness, accuracy, reliability, or suitability of any information contained on the Site, including but not limited to:
- Market statistics, property values, or price estimates
- Neighborhood information or school data
- Mortgage, financing, or interest rate information
- Legal descriptions or property characteristics
All real estate advertising and public statements are intended to comply with Section 475.25(1)(c), Florida Statutes, which addresses fraudulent, false, deceptive, or misleading advertising by licensees.
You should independently verify all information before making any real estate decision. Property values and market conditions fluctuate and past performance is not indicative of future results.
8. RESPA Compliance
I comply with the Real Estate Settlement Procedures Act (RESPA, 12 U.S.C. § 2601 et seq.). I am required to disclose any affiliated business arrangements and any referral fees or compensation I may receive in connection with a real estate transaction. Such disclosures will be made in writing at the appropriate time as required by law.
I do not accept undisclosed compensation, kickbacks, or unearned fees in connection with any real estate settlement service.
9. Email Communications and CAN-SPAM
Any commercial email communications I send comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.). You may opt out of commercial email communications at any time by replying with "UNSUBSCRIBE" or by contacting me directly. Transactional emails related to an active real estate matter are not subject to opt-out.
10. Limitation of Liability
To the fullest extent permitted by applicable law, I shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, this Site or any information contained herein, even if I have been advised of the possibility of such damages.
In no event shall my total liability to you for any claim arising from or related to the Site exceed the amount of fees, if any, you have paid to me in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
11. Intellectual Property
All content on this Site — including text, graphics, logos, images, and design elements — is the property of Richard Overvold or its respective licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works of any Site content without my prior written consent.
The Mutter Realty name, logo, and associated marks are the property of Mutter Realty and are used on this Site with permission.

This Site may contain links to third-party websites for your convenience. I do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site. You access third-party sites at your own risk.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Brevard County, Florida.
Before initiating any legal action, you agree to provide written notice of the dispute and allow thirty (30) days for good-faith resolution.
14. Florida-Specific Consumer Protections
Nothing in these Terms limits any rights you may have under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, Chapter 501, Part II, Florida Statutes) or other applicable Florida consumer protection law. These statutes protect consumers from unfair methods of competition, unconscionable acts, and deceptive trade practices.
15. Modifications to These Terms
I reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. Your continued use of the Site following any changes constitutes acceptance of the revised Terms.
